Agreement to these terms

These Terms & Conditions ("Terms") govern your use of the Trynexy website and your purchase of products from us. By accessing our website, creating an account, or placing an order, you agree to be bound by these Terms along with our Shipping Policy, Refund Policy, and Privacy Policy.

If you don't agree with any part of these Terms, please don't use our website or place an order. If you're using our website on behalf of a business, you confirm you have authority to bind that business to these Terms.

The Trynexy website and brand are operated by an Australian business based in Sydney, New South Wales. We sell and ship exclusively within Australia through this website.

For all correspondence — including questions about your order, warranty claims, privacy enquiries, and any formal notice under these Terms — please contact us at support@trynexy.com. Every email is read by a member of our Sydney team, usually within a few hours on business days.

Products & accuracy

We describe every product as accurately as we can, with photos and specifications that reflect what you'll receive. Minor variations in colour, texture, or hardware may occur between production runs — the photos on our website are representative, not contractual samples. Small differences in appearance due to lighting, screen calibration, or manufacturing updates are normal and are not considered defects.

If a material detail changes between what was advertised and what you receive, we'll either notify you before dispatch or treat it as a defect covered by section 7.

Pricing & payments

All prices are listed in Australian dollars (AUD) and include GST where applicable, unless stated otherwise. Shipping is free within Australia on all orders.

We accept major payment methods processed through Shopify Payments, which supports Visa, Mastercard, American Express, Apple Pay, Google Pay, Shop Pay, and PayPal. Buy-now-pay-later options (such as Afterpay or Shop Pay Installments) may be available at checkout.

Payment is authorised when you place your order and captured when we dispatch. If a product is listed at a clearly incorrect price due to a typo or technical error, we reserve the right to cancel your order and refund you in full rather than fulfil at the incorrect price.

Orders & when a contract forms

When you place an order on our website, you're making an offer to buy. A binding contract forms when we send you an order confirmation email — not when you click "Place Order" or "Complete Purchase." Until that confirmation is sent, we may decline your order for any reason, including:

  • The product is out of stock or has been discontinued
  • We identify an error in the product description or price
  • We suspect fraudulent payment or abuse
  • We can't deliver to your address

If we decline your order after payment has been taken, we'll refund you in full within seven business days.

Shipping & delivery

We ship free within Australia with tracking included. Estimated processing and delivery times are published in our Shipping Policy.

Delivery times are estimates, not guarantees, and may vary due to courier delays, public holidays, weather, customs inspections, or other factors outside our control.

Risk of loss or damage in transit remains with us until the carrier delivers the package to the address you provided. Once the parcel is handed over to you (or to any person at that address who accepts delivery), risk passes to you.

Returns & refunds

Our full returns terms are set out in our Refund Policy. In summary:

  • We refund or replace items that arrive damaged, defective, or incorrect, within 30 days of delivery.
  • Change-of-mind returns are not accepted under this policy.
  • Nothing in this section limits your rights under Australian Consumer Law — see section 9.

Warranty

Every Smart Vacuum Backpack™ includes a 24-month limited warranty against manufacturing defects in materials and workmanship — covering the bag body, the wireless vacuum pump, the zippers, the stitching, buckles, straps, and hardware.

Full coverage details, exclusions, and claim instructions are set out in Part 2 of our Refunds & Warranty page. To start a claim, email support@trynexy.com with your order number and clear photos or a short video of the defect.

This warranty runs in addition to, and does not limit, your rights under Australian Consumer Law — see section 9.

Your Australian Consumer Law rights

Your non-excludable rights

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).

Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These statutory guarantees sit alongside our 24-month warranty and our 30-day refund policy — they don't replace them. If you believe your ACL rights have been breached, contact us first at support@trynexy.com. If we can't resolve the issue, you may also contact the Australian Competition and Consumer Commission (ACCC) or your state consumer affairs authority.

Intellectual property

All content on the Trynexy website — including the Trynexy name and logo, the "Smart Vacuum Backpack™" branding, product photography, copy, graphics, icons, code, and overall website design — is owned by us or our licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.

You may view and share our content for personal, non-commercial purposes. You may not copy, reproduce, republish, translate, modify, distribute, or use our content for commercial purposes, or train machine-learning models on our content, without our prior written permission.

The Trynexy word mark and logo are trademarks of our business. Other product names mentioned on our website (including airline names such as Jetstar, Virgin Australia, Qantas, and Rex) are trademarks of their respective owners and are used here for descriptive purposes only.

Acceptable use of our website

When using our website, you agree not to:

  • Use it for any unlawful purpose or in a way that disrupts its operation
  • Attempt to access restricted areas, other users' accounts, or our underlying systems
  • Use automated systems (bots, scrapers, AI agents) to access, copy, or interact with our content without our written permission
  • Submit false, misleading, or infringing content through our contact forms, reviews, or any other input
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity
  • Transmit viruses, malware, spam, or any code designed to disrupt, damage, or compromise our systems
  • Resell, lease, or commercially redistribute access to our website or its content

We may suspend or terminate your access to our website at any time, without notice, if we reasonably believe you've breached these Terms.

Limitation of liability

Subject always to your non-excludable rights under Australian Consumer Law (section 9), and to the maximum extent permitted by law:

  • We are not liable for any indirect, consequential, incidental, or special loss — including loss of profits, data, or business opportunities — arising out of your use of our products or website.
  • Our total liability for any claim related to a product is limited to the price you paid for that product.
  • We are not liable for damage caused by misuse, accidents, unauthorised modifications, or normal wear and tear.
  • We are not liable for delays, failures, or losses caused by events outside our reasonable control — including courier delays, natural disasters, power outages, strikes, or failures of third-party systems such as payment processors.
  • We are not responsible for missed flights, forfeited bookings, or other travel consequences arising from the use (or non-use) of our products.

If you are a consumer in Australia, nothing in this section affects your statutory rights under the Australian Consumer Law.

Privacy

Your personal information is collected and used in accordance with our Privacy Policy, which forms part of these Terms by reference. Please read it to understand how we handle your data.

Changes to these terms

We may update these Terms at any time by publishing a revised version on this page. The "Last updated" date in the header tells you when they were last changed. Material changes will be communicated by email or an on-site notice where practical.

Continuing to use the website or place orders after a change takes effect means you accept the revised Terms. Your orders are always governed by the Terms in force at the time the contract forms (see section 5).

Governing law & jurisdiction

These Terms are governed by the laws of New South Wales, Australia, and the laws of the Commonwealth of Australia applicable there. Any dispute arising out of or in connection with these Terms is subject to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.

If you are a consumer resident outside Australia, nothing in this section deprives you of the protection afforded by mandatory provisions of the consumer protection laws of your country of residence.
